Internet companies complained about the monopolization of the brand “black Friday”

The dispute over the trademark Black Friday will consider the FAS. An application to the Agency was filed by the Association of companies of Internet trade which accuses the organizer of the first “black Friday” in Russia in the monopolization of the format

Association of companies the Internet-trade (AKIT) sent to the FAS statement with the request to stop violation of the legislation on protection of competition on the part of blehk, fraydey”.

“In our opinion, the company is committed unfair to monopolize a global and widespread for many years in Russia the format of an online sales Black Friday (black Friday), suggesting the Association of specific sites Network offers dozens of sellers on sale at significant discounts and with the seasonal nature of the worldwide (late November)”, — reads the statement, dated 27 September, which is available to RBC.

Blame “black Friday” is, in particular, the fact that the company has the exclusive right to a trademark Black Friday, which in fact is a “common term”, and has registered more than 50 similar domain names containing the designation Black Friday, but it actually doesn’t use them. In addition, according to the President of AKITA Alexei Fedorov, “black fraydey” spreading the information “misleading consumers are not misled”. To those Fedorov considers, for example, information posted on the website Blackfridaysale.ru where it is alleged that “the company OOO “black Friday” is the first and only organizer of all-Russian Online Sales Black Friday”, and the “official website Black Friday 2016 in Russia is www.blackfridaysale.ru”.

The representative of the FAS confirmed the receipt of the application, refraining from further comment.

In the “black fraydey” appeal “regarded” as yet another unfriendly step and try to pressure”, stressing that the company is not seeking to monopolize the format the Internet sales Black Friday”.

The format of “black Friday” came to Russia from the United States, where it originated in the XIX century. However, in the Russian Internet, the first “black Friday” is organized “black Friday” in 2013. Since then, the event is held annually at the end of November, the day after the American national holiday of thanksgiving. The official website of “black fraydey” among the partners are such retailers as Media Markt, Svyaznoy, MTS, re: Store, “l’etoile” and Sela. In total, according to the company, in 2015 the event was attended by 300 retailers. They presented about 150 thousand items and services, prices for which reached 90%. The turnover of the participants during last year’s stock has almost doubled compared with normal days, estimated by the service “Yandex.Money.” The total sales volume in 2015 exceeded 200 million rubles.

In January 2016, the Rospatent has registered a word mark for Black Friday of blehk, fraydey” on 35-th class of ICGS (International classification of goods and services). According to the commercial Director of “black fraydey” Svetlana Sharaburova, the company is implementing its exclusive right to the trademark in the manner prescribed by law. Other players, including members of AKIT, have also applied for trademark registration, rejected, refused from the further struggle. We presented evidence that the brand Black Friday became popular in Russia since the end of 2013 and thanks to the efforts of our company,” says Harborow.

The conflict broke out after the AKITA, which includes 30 online retailers, decided to organize in 2016 alternative sales. The Association called the action “Real “black Friday” and registered the website realblackfriday.ru. A number of members of the AKITA refused to participate in “black Friday” is “black Friday”.
