“Rada sent to the constitutional court a bill on the abolition of parliamentary immunity

Protesters outside the Parliament also require changes to the system of elections of people’s deputies and the creation of an anti-corruption court

– The Verkhovna Rada of Ukraine supported the inclusion in the agenda of the session and the direction of the constitutional court of the presidential bill on amendments to article 80 of the Constitution regarding the inviolability of people’s deputies.

In addition, the meeting supported the inclusion in the agenda and direction for the conclusions of the constitutional court of another bill on amendments to the Constitution regarding cancellation of immunity of people’s deputies – Deputy.

The presidential bill proposes to establish a new text of article 80 of the Constitution of Ukraine, excluding the norm according to which deputies of Ukraine are guaranteed parliamentary immunity, leaving only a part, according to which MPs do not bear legal liability for voting results or statements in Parliament, with the exception of liability for insult or defamation.

Of article 80 of the Basic law, in the case of the bill on amendments will be withdrawn a norm according to which deputies of Ukraine “are guaranteed parliamentary immunity”. Also removed from the Constitution the provision that “national deputies of Ukraine cannot be without the consent of the Ukrainian Parliament were brought to criminal responsibility, detained or arrested”.

Similar provisions are also contained in the draft law which was tabled in Parliament in July this year, more than 150 people’s deputies.

Essentially presidential (No. 7203) and Deputy (No. 6773) bills differ only in that according to the presidential initiative, changes to the Constitution in the abolition of immunity should enter into force on 1 January 2020 and not immediately after acceptance.

As stated earlier, the MP from the faction “Batkivshchyna” Serhiy Sobolev, the date of entry into force of the amendments to the Constitution will not be included in the “body” of the Basic law and will remain in the transitional provisions of the law, when passed, will allow by 226 votes to postpone the date of entry into force of the abolition of parliamentary immunity.
